World coalition judicial bodies:
“one commission” and “three law-enforcement arms”
(A) World coalition judicial commission
1. The jurisdiction and functions of the commission
The commission would be an independent and supreme judicial organization in the global political system. It is incumbent on the commission to give protection to the World Constitution and to interpret it. That a judicial system can provide a legislative system with significant enlightenment, assistance, or improvement is conditional on the positive impact jointly exerted by the overall political structure, the World Constitution, world coalition parliament, and world coalition government. The workings of a global judicial system would certainly gratify the desire of the world population in this connection. World coalition government, world coalition parliament, all national governments across the world, all religious organizations across the world, and all international organizations should subject themselves to the supervision, inquiry, and decisions of world judicial commission in accordance with law. The jurisdiction and activities of world coalition judicial commission should be in line with the World Constitution and pertinent world laws. The commission should exercise its power in accordance with the World Constitution, be independent of intervention or interference from any quarter, and refrain from dealing with disputes that have nothing to do with the law. When dealing with a case of group behavior, the commission should in the first place make sure whether litigants to a lawsuit are genuine and licit. The commission should never take advantage of loopholes in the laws to interfere with the functions of world coalition parliament or world coalition government. It is obligatory for the commission to punish particularly severely those who deliberately commit an offense against the law where they know they should not.
2. The setup of the commission
The said commission would be composed of one director, ten deputy directors, one president of world supreme court, one presiding judge of world supreme court, one president of the special court under world supreme court, one presiding judge of the special court under world supreme court, one president of world supreme prosecutorate, one presiding prosecutor of world supreme prosecutorate, one director of the independent prosecutorate under world supreme prosecutorate, one presiding prosecutor of the independent prosecutorate under world supreme prosecutorate, one commander-in-chief of world coalition police general headquarters, one chief of world police force, one chairperson of world lawyers’ administration, and one head lawyer.
3. The world lawyers’ administration attached to the judicial commission
The world lawyers’ administration under the control of world coalition judicial commission would be the most authoritative of all international lawyers’ organizations and all international law societies. The said administration is responsible for interpreting the World Constitution and all laws enacted by the world legislature and also for exercising leadership over and organizing all lawyers in the world. Moreover the said administration is held accountable for protecting legal rights and interests of all taxpayers in the world, for redressing injustice suffered by those who have been maliciously victimized, and for providing those who are too poor to afford the service of a lawyer with free legal service.
The candidates for the positions of chairperson of the world lawyers’ administration and head lawyer should be nominated by the president of world coalition government.
(B) World coalition supreme court
1. The authority and functions of world coalition supreme court
The said supreme court would be a judicial and arbitral body directly under the control of world coalition judicial commission, exercise the highest administrative and adjudicating power over the supreme courts in all countries across the world, and act as the supreme adjudicating organization to make the final decision on a dispute between countries, between the government of a country and a transnational company, a nongovernment organization, or an individual world citizen, between the government of a country and world coalition government, or between world coalition government and world coalition parliament. In all activities of a world coalition supreme court should be embodied the impartiality and authority inherent in the World Constitution and other laws enacted by world coalition parliament. Such a supreme court should protect the legal rights and interests of all world citizens and legal rights of all national governments across the world, all international organizations, nongovernment organizations, all transnational companies, and all transnational organizations. It would be incumbent on such a supreme court to accumulate experience from its judicial practice so that it would be in a position to provide guidance and help to a legislative body in the latter’s effort to draft a new law or amend an existing law. It would be wrong for such a supreme court to meddle in affairs legally under the jurisdiction of world coalition government or world coalition parliament, but it would be incumbent on such a supreme court to give support to both world coalition government and world coalition parliament and help both of them work harmoniously. It would be impermissible for such a supreme court to interfere with the jurisdiction and authority of any world coalition judicial body under some plausible pretext.
2. The authority and functions of the special court attached to world coalition supreme court
Being an extraordinary judicial and arbitral organization, the said special court would be placed under the direct control of world coalition judicial commission. But world coalition supreme court would be held accountable for administrating it and arranging for its daily routine. The said special court would be appointed by world coalition judicial commission based on instructions from both world coalition government and world coalition parliament and held responsible for giving ultimate ruling on a dispute between world coalition government and world coalition parliament, between governments of different countries, between political parties all over the world, and between the head of state of a country and an organization in that country. The said special court should strictly observe the regulations governing the work procedures befitting the extraordinary circumstances under which the said special court would have to work. Unless otherwise instructed by world coalition judicial commission, it would be impermissible for the said special court to decide to throw a case out. No member of the said special court is allowed to abuse his or her power for personal gains.
(C) World coalition supreme prosecutorate
1. The authority and functions of such a supreme prosecutorate
World coalition supreme prosecutorate which would be placed under the direct control of world coalition judicial commission would be the highest organization responsible for instituting legal proceedings against someone or some organization and exercise the highest administrative power and the highest prosecutorial power over all prosecutorial organizations in all countries in the world. Such a supreme prosecutorate should be responsible for both picking out from among all the criminal cases submitted to it by world coalition police general headquarters such cases as ought to be tried by world coalition supreme court and instituting and carrying on legal prosecution based on such cases. The supreme prosecutorate should be held responsible for instituting prosecution against offenders in cases or events that have telling impact upon world politics, world economy, a world citizen’s legal rights and interests, or a religious faith. As such a supreme prosecutorate would operate as a key link in the chain of world coalition judicial system, it should be very dutiful and careful in its operation to ensure that all the cases in which it would institute prosecution are most thoroughly and opportunely investigated, really worthwhile for a world coalition supreme court to hear them, and strictly in accordance with legal procedure. Moreover such a supreme prosecutorate should be held responsible for offering prosecutorial counsel to both the efforts of world coalition legislative system at enacting new legislation and the efforts of world coalition administrative system at formulating policies and making decisions.
2. The authority and functions of the special prosecutorial office attached to world coalition supreme prosecutorate
Placed directly under the control of world coalition judicial commission, the said office would be a special judicial and prosecutorial setup administered by world coalition supreme prosecutorate which would be responsible for arranging its day-to-day operation. The sole duty of the said office would be to independently institute prosecution in such extraordinary cases as are officially designated by world coalition judicial commission and consented to by world coalition parliament. Parties involved in such extraordinary cases might be countries, special groups, or special persons. The said office should be fully aware that the mission it should carry out is solemn, upright, and sensitive. It would be incumbent upon the said office to safeguard the World Constitution and the rights and interests of the parties to a case to be handled by it. All members of the said office should be moral and exemplary in all respects so that they would be the models for all world citizens to follow suit. The said office would be entitled to bring a lawsuit against a country which—or a person who—is guilty of interfering with or disturbing the office’s independent prosecutorial operation. The said office would be also entitled to request world coalition judicial commission to give it support or to protect the safety of its members.
(D) World coalition police general headquarters
1. The authority and functions of the world coalition police general headquarters
The said general headquarters would be an enforcement arm under the direct control of world coalition judicial commission and emerge as the highest enforcement organization carrying out the tasks of ensuring public security and preventing criminal activities in accordance with the World Constitution and other world coalition laws. The armed police force under the command of the said general headquarters should be held responsible for ensuring the security of (1) all the organizations and institutions within the system of world coalition government and that of world coalition parliament, (2) sovereignty and independence of any country in the world, (3) all religions in the world, (4) normal operation of all international organizations and nongovernment organizations, and (5) all legal rights and interests of a world citizen. The said general headquarters would be the highest leading organization of all national armed police forces over the world. When detailed to carry out a mission in a country, member from world coalition police general headquarters should be duly respected and assisted by that country. Unless officially assented to by the government of a host country or by the pubic security department of a host country, a member sent from world coalition police general headquarters to that country should not enter any guarded area in that country. Without permission from the person concerned or party concerned in a host country, a member sent there by world coalition police general headquarters should not intrude into the person’s or the party’s private assets or carry out an enforcement task there. When confronted with an armed attack or armed interference with his or her legal act of law enforcement, a member detailed by world coalition police general headquarters would be entitled to practice self-defense.
2. The authority and functions of the special police department attached to world coalition police general headquarters
Though placed under the direct control of world coalition judicial commission, the said department would be administered by world coalition police general headquarters. Every act of law enforcement to be carried out by the said department should be authorized in the first place by the chairperson of the executive committee of world coalition parliament and then jointly approved by both director of world coalition judicial commission and director of the special police department. In fulfilling his or her law enforcement duty, a member of the special police department should not be restrained by any interference from the system of world coalition government, the system of world coalition parliament, or normal—or conventional—judicial procedures. When confronted with interference with or obstruction to his or her legal act of law enforcement, a member from the special police department should be entitled to assistance provided by a host country or by its police forces. In that event it would be obligatory for a host country or its police forces to extend the help. In carrying out his or her legal act of law enforcement, a member of the special police department should overstep neither the bounds nor the scope legally defined for the special police department to stay within in the course of enforcing law and be entitled to armed self-defense in case his or her legal act of enforcement be interrupted by armed attack. A member of the special police department should be constantly mindful of his or her obligations and duties, refrain from any obsession with his or her prerogative, and perform his or her duties exemplarily.
